By installing or using HARMONICS™: ORAKL ("the App"), you accept these Terms of Use (EULA). If you do not agree with these terms, do not use the App.

These terms constitute a binding legal agreement between you and Harmonics.

We grant you a personal, non-exclusive, non-transferable, and revocable license to use the App on a device you own or control, in accordance with App Store and/or Google Play Store rules.

No ownership rights are transferred to you. All rights not expressly granted remain reserved.

This license is subject to your compliance with these Terms and applicable platform policies.

The license terminates automatically if you violate any terms or conditions.

You are responsible for maintaining the confidentiality of your login credentials and all associated account activity.

The App is not intended for users under 13 years of age (or the minimum age in your jurisdiction).

You must provide accurate and up-to-date information when creating your account.

One account per person - sharing accounts is prohibited.

You agree to notify us immediately of any unauthorized use of your account.

PREMIUM SUBSCRIPTION PLANS:

• Monthly Plan: €9.90 per month

• Annual Plan: €99 per year (save €19.80 - equivalent to 2 months free)

• Prices are indicative and may vary by country, taxes, and app store policies

BILLING & RENEWAL:

• Payment is charged to your Apple ID account (iOS) or Google Play account (Android)

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

SUBSCRIPTION MANAGEMENT & CANCELLATION:

• iOS: Settings → [Your Name] → Subscriptions (or App Store → Account → Subscriptions)

• Android: Google Play → Payments & Subscriptions → Subscriptions

• You can cancel anytime, but cancellation takes effect at the end of the current billing period

FREE TRIALS:

• When offered, free trials automatically convert to paid subscriptions unless cancelled before trial ends

• Trial periods may vary and are subject to change

REFUNDS:

• Managed by Apple/Google according to their respective refund policies

• Partial periods are not refundable once started

• Contact Apple/Google customer support for refund requests

PURCHASE RESTORATION (iOS):

• Available from your account if you reinstall the App or change devices

• Requires same Apple ID used for original purchase

All audio streams, playlists, and App content are protected by intellectual property rights and provided for strictly personal use only.

PROHIBITED ACTIVITIES:

• Reproduction, redistribution, or mass extraction of content

• Commercial use without written authorization

• Creating competing services using our content

• Downloading or storing content outside the App

• Reverse engineering our recommendation algorithms

HARMONICS™, ORAKL™, and MURMUR™ are registered trademarks.

Music content is licensed from our distribution partners for personal streaming only.

You receive a personal, non-transferable license to use the app according to these terms.

You represent that you have the necessary rights to any content you submit to the App.

By submitting content, you grant us a limited license to use it within the technical framework of the App.

This includes playlists, preferences, reviews, and any other user-generated content.

You retain ownership of your personal data and user-generated content.

We may remove user content that violates these terms or applicable laws.

You are solely responsible for the content you create and share.

The following behaviors are strictly prohibited:

• Illegal, harmful, defamatory, or intrusive usage

• Security circumvention or unauthorized access attempts

• Reverse engineering of our AI algorithms or app functionality

• Scraping, data mining, or automated data extraction

• Overloading or attempting to disrupt our servers

• Creating fake accounts or impersonating others

• Sharing account credentials with third parties

• Using bots, scripts, or automated tools to access the service

• Violating other users' privacy or rights

• Any activity that could harm the App or other users

The App relies on third-party services including Apple, Google, Firebase, and other technology providers.

Their availability and terms may impact our service delivery.

Third-party services are governed by their own terms and conditions:

• Apple App Store Terms of Service

• Google Play Terms of Service

• Firebase Terms of Service

• Music streaming service provider terms

We are not responsible for third-party service interruptions or policy changes.

Changes to third-party services may affect App functionality.

You agree to comply with all applicable third-party terms when using the App.

Your privacy is important to us. Our Privacy Policy explains what data we process and why:

KEY PRIVACY HIGHLIGHTS:

• MURMUR voice processing is handled locally on your device

• We collect minimal data necessary for service functionality

• Your personal data is protected under GDPR and applicable privacy laws

• You have rights to access, modify, and delete your personal data

• We do not sell your personal information to third parties

• Data retention policies are detailed in our Privacy Policy

By using the App, you consent to data processing as described in our Privacy Policy.

You can control your privacy settings within the App at any time.

You may cancel your subscription and delete your account at any time through your account settings.

We may suspend or terminate accounts that violate these Terms of Use.

UPON TERMINATION:

• Your access to Premium features will end at the current billing period

• Your account data will be deleted after 30 days (as per our data retention policy)

• No refunds will be provided for unused subscription periods

• You may lose access to saved playlists and preferences

• Downloaded content (if any) will become inaccessible

ACCOUNT REACTIVATION:

• You may reactivate your account within 30 days of deletion

• After 30 days, all data is permanently deleted and cannot be recovered

HARMONICS is provided "as is" without express or implied warranties.

We do not guarantee uninterrupted, error-free, or secure service.

Our AI recommendations (ORAKL, MURMUR) are generated algorithmically and may not always match your preferences.

LIABILITY LIMITATIONS:

• To the fullest extent permitted by law, we are not liable for indirect, consequential, or incidental damages

• Our total liability is limited to the amount you paid for the service in the past 12 months

• We are not responsible for issues caused by your device, internet connection, or third-party services

• Force majeure events (natural disasters, government actions, etc.) are excluded from liability

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

These Terms are governed by the laws of France (European Union), unless local consumer protection law requires otherwise.

Any disputes will be resolved in French courts, subject to applicable consumer protection laws.

DISPUTE RESOLUTION PROCESS:

1. Contact us first at charlesrocher75@gmail.com to resolve issues amicably

2. If unresolved, disputes may be submitted to mediation

3. Legal proceedings as a last resort in competent French courts

SEVERABILITY:

• If any provision of these Terms is found invalid, the remaining provisions continue in effect

• Invalid provisions will be replaced with valid provisions that achieve similar intent

UPDATES TO TERMS:

• We may update these Terms from time to time

• Continued use after changes constitutes acceptance of new terms

• Significant changes will be communicated via the App or email
